The Andhra Pradesh High Court on Thursday directed the CBI to register a case against nine police officers of Warangal district, including the SP, for allegedly torturing Kakat-iya University research scholar V. Yakub Reddy.
Following the direction, the CBI will register cases against Warangal SP Rajesh Kumar, Warangal DSP Ajay Kumar, Kazipet DSP Venkat Narasaiah, SHO Ranadir, Subedari SI Ravi Kumar, Ghanpur CI Venkateswara Reddy, Matwada CI Balu Jadhav, Matwada SI Srinivas and Dharmasagar SI Srinivas. Mr Yakub Reddy had challenged the action of the police in apprehending, detaining and causing injuries to him. While invoking the writ jurisdiction of the High Court, Mr Yakub Reddy urged the court to register a case against the police officers.
Earlier, a single judge dealt the matter and referred it to a division bench comprising Justice Ghulam Mohammed and Justice K.G. Shankar, to decide a question of law in view of findings of the Apex Court in Sakiri Vasu versus state of UP case, whether the High Court can grant a direction for registration of case when there are remedies available under the provisions of the CrPC.
Justice Ghulam Moham-med, referring to the findings of the Apex Court, said that “the case is an extraordinary one. With regard to the peculiar facts of the case, pending answer to the reference of the single judge and also pending disposal of the writ, we deemed it appropriate to direct the CBI, director to register a case against the police officer.” The bench told the CBI to register a case and investigate into the unlawful, illegal action of gross physical abuse and custodial torture committed by the police officers.
Mr Yakub Reddy was arrested during the Telangana agitation for his alleged involvement in attack on the house of information technology minister Ponnala Laxma-iah at Warangal on September 7, 2011.
He was admitted in MGM hospital at Warang-al and was later shifted to Gandhi hospital in Hyderabad.
Orders reserved on VIjay Sai plea
Justice Raja Elango of the High Court directed the CBI to file a counter affidavit on the plea of V. Vijay Sai Reddy, vice chairman of Jagathi publication and accused in assets case of Kadapa MP Y.S. Jagan Mohan Reddy. Mr Vijay Sai Reddy has moved the High Court after the CBI court refused his application to restrict the CBI from going beyond the business transactions of Mr. Jagan Mohan Reddy prior to 2004. He urged the judge to direct the CBI to confine the investigation to the business affairs from 2004 to 2009.
Mr. S. Niranjan Reddy, counsel for the petitioner complained that the CBI had been harassing his client in the name of enquiry. He said that the CBI was going ahead with the probe prior to 2004 without informing the HC, in contravention to an earlier court order. CBI counsel P. Kesava Rao, referring to investments of Rs 125 crore into Sandur Power (owned by Mr Jagan Mohan Reddy) by Mauritius-based companies, said that if situation warrants, the CBI have to look into business transactions of the accused prior to 2004 to establish if illegalities took place between 2004 and 2009.
The judge asked the counsel for the petitioner, how and under what circumstances, can the court impose restrictions on investigations into a criminal case. The judge adjourned the case till after Sankranti vacation.
Case against DFO stayed
Justice Raja Elango of the High Court granted stay on criminal proceedings pending against Karnat-aka state divisional forest officer Rajasekhar. Raidurgam police in Anantapur district had registered a case against the DFO and four others on the complaint of representatives of Obulapuram Mining Company owned by former Karnataka minister Gali Janardhan Reddy on the ground that they trespassed into territory of OMC and removed the boards erected by the AP Forest Department.
Mr Rajasekhar's counsel Pradumna Kumar Reddy argued that his client was a government servant and he could not be prosecuted without prior sanction from the government.
Yakub Reddy was picked up by the Warangal police in connection with a dharna by KU-JAC students in front of state minister Ponnala Lakshmaiah’s house on September 7th, 2011. Yakub Reddy was among two dozen students, who were arrested by the district police and tortured severely. It is learnt that Ponnala Lakshmaiah had himself called up the district police and asked them to ‘teach a lesson’ to these students, who had dared to conduct a dharna in front of his house. Apparently, Ponnaala was peeved because the agitating students had smashed a photo frame of UPA chairperson Mrs. Sonia Gandhi.

Yakub Reddy, who was brutalized by the district police, was first admitted in MGM hospital Warangal in a very critical condition and was later shifted to Yashoda Hospital, Hyderabad. Since then he has been undergoing treatment.
The Telangana Lawyers JAC had earlier lodged a complaint about this police brutality at the state Human Rights Commission. The SHRC had asked for a detailed report from the state DGP on this incident.
Several Telangana leaders including KCR, Chukka Ramaiah, Nagam Janardhan Reddy, Kalvakuntla Kavitha, Eetela Rajendar had visited Yakub Reddy while he was undergoing treatment at Yashoda Hospital.
